Welcome to the Martin et al. v. Olan Mills, Inc., Case No. 12C-122 Class Action Settlement website
If you are a current or former employee of Olan Mills, Inc. who worked as a photographer in Olan Mills’ Church Division, Olan Mills’ OM Kids Division, or Olan Mills’ Fundraiser Division at any Olan Mills location nationwide between August 17, 2007 and January 10, 2012, this class action settlement may affect your rights.
The Lawsuit seeks to recover compensation for meal periods and rest breaks, overtime, minimum wage and related relief, including penalties, from Olan Mills for the Representative Plaintiffs and for all similarly-situated current or former employees of Olan Mills. The parties to the Lawsuit have reached a Settlement of the claims asserted in the Lawsuit, which, among other things, provides for monetary payments by Olan Mills to all persons entitled to participate in the Settlement who properly complete and submit a claim before the deadline for doing so.
Although Olan Mills acknowledges that all photographers employed in its Church, OM Kids, and Fundraiser divisions were classified by Olan Mills as being exempt from overtime under the FLSA, Olan Mills denies that such classification was incorrect. Olan Mills denies any liability or wrongdoing of any kind associated with the claims asserted by the Representative Plaintiffs. Olan Mills contends that it has complied with all applicable federal and state law concerning the compensation of its employees at all times.
THE DEADLINE TO FILE A CLAIM IS SEPTEMBER 27, 2012
